These Terms & Conditions outline the terms under which Rivergum Digital provides website design and related digital services. By engaging our services or using this website, you agree to these Terms & Conditions.
We believe in honest communication, fair pricing and building websites that genuinely help small businesses succeed. These Terms are designed to ensure every project runs smoothly and that both you and Rivergum Digital understand our responsibilities.
1. Services
Rivergum Digital provides website design, website development, website hosting, domain registration assistance, website care and related digital services.
The services included in your project will be outlined in your quotation, proposal or written agreement.
2. Quotes and Pricing
All quotations are provided in Australian Dollars (AUD).
Unless otherwise stated, quotations remain valid for 30 days from the date they are issued.
Any work requested outside the agreed project scope may require a separate quotation and additional fees.
3. Payment
Payment terms will be outlined in your quotation or proposal.
Project invoices and ongoing Website Care Plan fees must be paid by the due date specified on the invoice.
Rivergum Digital reserves the right to delay commencement, suspend work or withhold publication of your website until all outstanding invoices have been paid.
4. Project Scope
Each website is designed and developed according to the agreed project scope.
Requests for additional pages, functionality, features or significant design changes after work has commenced may be quoted separately before the work is undertaken.
5. Client Responsibilities
To help us deliver your project on time, clients agree to provide all information reasonably required to complete their website, including business information, branding, logos, written content and any specific images they wish to use.
Where appropriate, Rivergum Digital may source and include suitable royalty-free or licensed stock images to complement your website design. The selection of stock imagery is at Rivergum Digital’s discretion and will be based on suitability for your business and the overall design.
Clients are responsible for ensuring they have the necessary rights or permission to use any content, images, logos or other materials they provide.
Delays in supplying required information or approvals may result in project delays.
6. Revisions
Reasonable revisions are included during the website design process.
Requests that significantly alter the original project brief or require substantial redesign may be treated as additional work and quoted separately.
7. Project Delays
If a project becomes inactive due to delays in communication, approvals or the supply of content, Rivergum Digital may place the project on hold.
Projects recommencing after an extended period may require revised scheduling or updated pricing where appropriate.
8. Website Launch
Your website will be published once:
- all required content has been supplied;
- final approval has been received; and
- all outstanding project invoices have been paid.
9. Included Hosting & Domain
Your website package includes managed website hosting and one domain name for the first 12 months.
After the initial 12-month period, hosting and domain registration are renewable annually at Rivergum Digital’s current rates.
If you choose not to renew your hosting with Rivergum Digital, you may transfer your website and domain to another provider.
10. Third-Party Services
Rivergum Digital may recommend or configure third-party services including domain registration, Google services, premium plugins and other software.
These services are provided by independent third parties.
Rivergum Digital is not responsible for service interruptions, outages, pricing changes or policy changes made by these providers.
11. Google Search & Performance
Rivergum Digital includes basic Google Search setup and Google Analytics configuration where included in your chosen package.
While websites are built following recognised best practices, Rivergum Digital cannot guarantee search engine rankings, website traffic, enquiries or sales.
12. Website Ownership
Once your website has been completed and all project invoices have been paid, you own your website.
Rivergum Digital includes managed website hosting and your domain name for the first 12 months as part of your website package.
After the first year, hosting and domain registration may be renewed annually if you wish to continue using our managed hosting service.
If you choose to move your website to another hosting provider, Rivergum Digital will provide the website files and database or assist with migration where agreed. Additional migration work beyond a standard website handover may incur additional charges.
13. Website Care Plan
Rivergum Digital offers an optional Website Care Plan for clients who would like ongoing maintenance and support.
The Website Care Plan currently includes:
• WordPress core updates
• Theme updates
• Plugin updates
• Regular website backups
• Security monitoring
• Up to 15 minutes of minor content updates each month
Minor content updates include simple text edits, replacing images, updating business information and other small changes to existing pages.
Major design changes, additional pages, new functionality or redevelopment work are not included and may incur additional charges.
Website Care Plan pricing will be outlined in your proposal or agreement and may be updated from time to time with reasonable notice.
14. Cancellation of the Website Care Plan
You may cancel your Website Care Plan at any time by providing 30 days’ written notice.
Cancelling the Website Care Plan does not affect your ownership of your website.
If your website is hosted by Rivergum Digital, alternative hosting arrangements will need to be made before your hosting service ends.
Following cancellation, Rivergum Digital will no longer provide software updates, backups, security monitoring or minor content updates.
15. Portfolio
Unless otherwise agreed in writing, Rivergum Digital reserves the right to display completed websites, designs and project details within our portfolio, social media and other marketing materials for the purpose of showcasing our work.
16. Limitation of Liability
To the maximum extent permitted by law, Rivergum Digital is not liable for any indirect or consequential loss arising from the use of this website or our services.
This includes, but is not limited to:
- loss of profits;
- loss of business opportunities;
- website downtime;
- data loss;
- cyber security incidents;
- interruptions to third-party hosting or domain services.
- issues caused by third-party software or service providers.
Nothing in these Terms excludes any rights available under Australian Consumer Law.
17. Australian Consumer Law
Nothing contained within these Terms & Conditions excludes, restricts or modifies any consumer guarantees or rights available under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law.
18. Changes to These Terms
Rivergum Digital may update these Terms & Conditions from time to time.
The most current version will always be published on this website.
